If the judge did not adhere to what the law says then I would call that special treatment.

I have not done enough research on this to be a valid source but as far as I know, she did follow the law.

Judging by the fact that she did not treat him any differently than she would the average joe and she is still in charge of that court, she would have to be following the law. I have not heard any complaints about the way she treats her cases and would also consider that a sign that she is acting according to the law.

Check Ga Code: 40-5-121 (a)  No where in the code does it say that if the accused license are suspended that he can run down to the Driver License Service get them reinstated and then the offense will be reduced to a warning at the judges discretion.  That would be like saying if someone was DUI that the judge could just give them a warning if they sober up.

Thanks for the research, I thought that was correct but was not for certain.  It is well established that it all depends on who you know, who your are .....It is the scratch my back and I will scratch yours system.  It is really hard how someone can have only numerous charges, but when they go to court, "well let me see I will have to use one charge but the others, OOPS, they dissapear."   This is not only referring to the commissioner's case.  I could go on and on.

I still don't understand how it is special treatment if he is getting treated the same way that everyone else in that jurisdiction is getting treated.

Not having your license and one that was suspended for 7 years is a little different!

There were probably about 5 or 6 people that went before the judge with similar charges and they were reduced to warnings with proof of a current license.

I would hope that they did not have a suspended license for 7 years and use their office to get out of it!!!

Ok, then the judge gave 5 or 6 people special treatment.  The law says what the penalty is and the judge ignored it.  Because he didn't follow the law makes it special treatment.
